米控訴裁、現役トランス兵の除隊を当面停止
米国控訴裁判所の判断
ロイターが6月1日に伝えたところによると、米国の控訴裁判所は、トランスジェンダーの現役兵士を国防総省が除隊させることを、訴訟が続くあいだ止めた。
Reuters reported on June 1 that a U.S. appeals court blocked the Pentagon from discharging current transgender service members while the lawsuit continues.
その一方で、裁判所は、トランスジェンダーの人が新たに入隊することを当面認めない 政府方針は続けられると示した。
At the same time, the court indicated that the government's policy of blocking new transgender enlistments can remain in place for now.
裁判所が示した 理由
2対1の判断で、裁判所は2025年の政策が、政治的に弱い 集団を傷つけたいという思いに基づいた 可能性があると述べた。
In the 2-1 ruling, the court said the 2025 policy may have been motivated by a desire to harm a politically unpopular group.
ウィルキンス判事は、新しい仕事の開始を遅らせることより、すでにある軍歴を終わらせることのほうが、より大きな不利益だという考えを示した。
Judge Wilkins said ending an existing military career would create a bigger hardship than delaying the start of a new one.
ただし、ウォーカー判事は反対意見で、軍がだれを受け入れるかは、裁判所に決める 権限も専門性もないと述べた。
Judge Walker dissented, saying courts do not have the authority or expertise to decide who the military may accept.
前段階の裁判と政権方針
今回の判断は、ワシントンの連邦地裁が2025年に政策全体を差し止めた 決定を一部維持したかたちとされる。その地裁は、その政策が性差別にあたり、憲法の平等保護にも反する 可能性があると見た。
The decision was reported as partly upholding a 2025 ruling by a federal district court in Washington that had blocked the entire policy. That lower court saw possible sex discrimination and a possible violation of constitutional equal-protection guarantees.

Reuters said President Trump argued in a January 2025 executive order that a transgender identity conflicts with the discipline expected of soldiers, and Defense Secretary Pete Hegseth later implemented that order.
反応と今後
原告側を支えるGLAD Lawのジェニファー・レビ氏は、この判断を歓迎した。いままで厳しい基準を満たしてきた 現役兵を守る 内容だと述べたと報じられている。
Jennifer Levi of GLAD Law, which represents the plaintiffs, welcomed the ruling. Reuters said she described it as protection for current troops who had already met strict service standards.
国防総省はすぐにはコメントしていないと伝えられた。報道では、この政策はトランプ政権がトランスジェンダーの人々への認識や配慮を広く縮めようとする 動きの一部だとされた。
The Pentagon did not immediately comment, Reuters said. The report added that the policy is part of a broader administration effort to reduce recognition and accommodation for transgender people.

This ruling keeps protections in place for current service members, but the treatment of new enlistments remains restrictive. The legal fight appears likely to continue for some time.
